December Term 1843

 

State of Tennessee, Benton County, December Term 1843

At a county Court began and held at the Court house in the Town of Camden on the first Monday in December it being the fourth day of said Month in the year of our Lord one thousand eight hundred & forty three and the sixty eighth year of American Independence there being present and presiding on the bench the worshipfuls Esquires E. Perkins Chairman, D.H. Hudson and Nathan Williams.

Personally appeared in open Court Berry W. Whitly returned the sale bill of the property of Starlin Whitly Dec. and oath having been Made to the same.  It is ordered by the Court to be Entered of record.

On Motion it is ordered by the Court that Thomas Jones the appointed overseer of the stage Road in room of Joseph Cowell, Jr. To work from the Town of Camden to the 13 Mile Tree and all the hands that formerly worked under said Cowell with Hugh M. Brown, Roger Murphy, Matison Wiseman, Joseph Wiseman, William Wiseman, Oliver Auston, Brown Bridges, Alexander Wiseman, and all the hands in said bounds shall work under said Jones on said road which is established in the 1st Class.

On Motion it is ordered by the Court that James Butler be appointed overseer of the road in room of Leonard Pope to work from Hugh Darby's old place to John Morris' and that the following hands work under said Butler on said road (viz) Charles Kee, Gustin H. Barker, Hillsman King, I.W.P. Lewis, James Nevins and William Lewis and all other hands in the bounds shall work under said Butler on said road which is established in the 2nd Class.

On Motion of David Brewer who Made oath in due form of law and together with him Nicholas Brewer his security who entered into the acknowledged their bond in the penal sum of two hundred & fifty dollars conditioned as the law directs.  It is ordered by the Court that the said David Brewer have letters of administration of the estate of Daniel Brewer deceased to be Made out in due form of law when required.

December Term 1843

On Motion it is ordered by the Court that Thomas McGill, Samuel Madden, William Wood, R.N. Wood, Simeon Higdon, J.R. Thomas and Wilson M. Serrett be appointed as a Jury of Review to view and Mark an alteration in the road leading from the State road near C.M. Serretts to Sneed's ferry and that the said Jurors make report to the next term of this Court.

On Motion of Wilson M. Serrett and Amos Bruce who made oath, according to law and together with Seth Utley, Michael Fry and Jesse Hammonds their securities who appeared in open court & entered into and acknowledged their bond in the penal sum of three thousand dollars conditioned as the law directs, it is therefore ordered by the Court that the said Wilson M. Serrett & Amos Bruce have letters of administration upon the estate of Mary Serrett deceased with the will of John Serrett deceased annexed to be made out in due form of law when required.

The Clerk of this Court presented a settlement Made with James R. Nance guardian of the Minor heirs of John D. Neeber deceased which said settlement was examined and approved by the court and ordered to be recorded.

Personally appeared in open Court Henry W. Davis administrator of the estate of Judah Davis deceased who Made report to this court that there had come Nothing into his hands as yet and oath having been Made thereto.  It is ordered by the Court to be recorded.

The Court proceeded to appoint Revenue Commissioners to take a list of taxable property & polls in Benton County who for the year 1844 are as follows (viz.)

December Term 1843

On Motion by the Court that Charles Moore be appointed overseer of the road to work from the creek near Samuel Pearces to the late residence of John Morris and the following hands shall work under said Moore on said road (viz.) L.H. Pope, Geo. W. Kilbreath, Albert Aden, Irvin Earp and Nelson Pearce and all other hands in the bounds shall work under said Moore on said road which is Established in the 2nd Class.

On Motion it is ordered by the Court that Milton Elmore be appointed overseer of the stage road in room of William Berryhill to work from Lewis Cross's to the Carroll County line and all the hands that formerly worked under said Berryhill or in the bounds shall now work under the said Elmore on said road which is established in the 1st Class.

On Motion it is ordered by the Court that John McAuley be appointed overseer of the road in Room of Joseph Walker to work from Little Cypress Creek to Carroll County line and that the following hands work under said McAuley on said road (viz.) John Garrett, Stephen Garrett, Julius Cole, John Cole, Ira Cole, David Forrester, Stephen Walker, Giles Marchbanks, Joseph Walker, George Moore, Anderson Moore, Joseph Cole and Mishack Dean shall work under said McAuley on said road which is established in the 2nd Class.

On Motion of Katherine Howe who Made oath according to law and together with Emsley Howe, Nathaniel Nunnery and Thos. Jones, her securities, who appeared in open court and entered into and acknowledge their bond in the penal sum of one thousand dollars conditioned as the law directs.  It is therefore ordered by the court that the said Katherine Howe have letters of administration upon the estate of William Howe deceased with a noncupative will of the said William Howe deceased anexed to be Made out in due form of law when required.

December Term 1843

Personally appeared in open Court one of the commissioners who were appointed at a former term of this court to lay off and set apart a sufficiency of provisions to serve the widow & family of the late John Morris Deceased and presented their report which is ordered by the Court to be recorded.

On Motion it is ordered by the Court that William Wormack be appointed overseer of the road leading from Esq. Floyd to the Paris road near the levee on this side of Sandy and the following hands work under said Wormack on said road (viz) John G. Allen, Edmond Brewer, Robert Jones, Hiram Pearce, William Clack, Jones Yarbrough, Hugh Alsop and Daniel Buchanan and all other hands in the bounds shall work under said Normack on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that Achilles Wilson be appointed overseer of the road leading from Willis Rushing's to Wyatt's bridge on Sandy as far as Thos. L. Floyd's on said road and that the following hands shall work under said Wilson on said road (viz) William Cole, Sterling Brewer, J.W. Brewer, Burrell Bell, David Busby, John Rushing, Henry Raburn and Williams Taylor and all other hands in the bounds shall work under the said Wilson on said road which is established in the 2nd Class.

On Motion of Thomas Jones it is ordered by the Court the road leading from Camden to Travis' Mill be disannuled and for Nothing established.

On Motion it is ordered by the Court that Zepheniah Collins be appointed overseer of the stage road to work from the Town of Camden to Beaverdam Creek and that the hands that formerly worked under him with the addition of all the hands East and South of Camden including B. Hardy that formerly worked under I.B. Carnes shall work under said Collins on said road which is established.

December Term 1843
State of Tennessee vs. Peter Phifer, Bastardy

This day the papers and documents relative to this Cause where returned into Court by Elijah Alsup an acting Justice of the peace in and for said County and the Cause came on to be heard by the Court and it appearing to the Court from the record aforesaid that the said Justice had not given any judgment in said cause.  It is therefore considered by this Court that this Cause is not properly in this Court and that the same be hence dismissed.

Court then adjourned until Court in Course.

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in January it being the first day of said Month in the year of our Lord one thousand eight hundred & forty four & 68th year of American Independence.  There being present & presiding on the bench the following Esquires (viz) E. Perkins, D.P. Hudson, Nathan Williams, William Barnes, John M. Davidson, Wm. M. McAuley, Geo. W. Farmer, Elijah Alsop, Thos. L. Floyd, Samuel S. Davidson, John D. Rushing, Hezekiah Greer, Burrell Beard, William A. Steele and Joseph R. Mathews.

The Clerk of this Court presented a settlement Made with John F. Johnson Guardian of the Minor heirs of William B. Griffith deceased which said settlement was examined & approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement with C.K. Wyley, Treasurer of the board of Trustees for Benton County Academy which said settlement was examined by the Court & referred for further consideration.
