December Term 1842

 

State of Tennessee, Benton County, Dec. Term 1842

At a County Court began and held for the County of Benton at the Court house in that town of Camden on the first Monday in December it being the fifth day of said Month and in the year of our Lord one thousand eight hundred and forty two and the 67th year of American Independence there being present and presiding on the bench the worshipfuls Esquires D.P. Hudson, Chairman, E. Perkins, G.W. Farmer, Justices to hold said Court of Quorum.

On Motion it is ordered by the Court that Geo. Francisco be appointed overseer of the road from Pearce's Bridge to the Henry County line in room of W. Rowe and that the hands that formerly worked under said Rowe or in the bounds shall now work under said Francisco on said road & said road is Established in the 2nd Class.

Issued Dec. 8th 1842.

Personally appeared in open Court William Malin Admr. of the Estate of James Malin Dec'd. and returned a supplementary inventory & amount of sale on oath of said Estate of James Malin Deceased.

The Court then proceeded to appoint Revenue Commissioners to take a list of Taxable property and polls for Benton County for the year 1843 as follows (to wit)

1st District, Jesse Hammonds
2nd District, Nathan Williams
3rd District, Wm. Barnes
4th District, J.W. Davidson
5th District, D.P. Hudson
6th District, Hez. Greer
7th District, G.W. Farmer
8th District, Thos. L. Floyd
9th District, Jesse D. Hall

And they the said Commissioners to Make return as the law directs.

Personally appeared in open Court William P. Lashlee who from the certificate of the proper officer was duly elected Constable on the 26 day of November 1842 - in the Civil District No. 5. And together with, Lewis Lashlee, Thos. Jones, Bennett S. Browning and Ephram Arnold his securities & entered into & acknowledged their bond in the final sum of

Dec. Term 1842

four thousand dollars, conditioned as the law directs, he having taken the oath to support the constitution of the State of Tennessee & that of the United States & also to prohibit Dueling & also the oath of office.

On Motion it is ordered by the Court that Joseph Cowell Junior be appointed overseer of the stage road in room of Mathew Presson from the ford of the Creek near Thomas Jones' to the Thirteen Mile tree & that all the hands that formerly worked under said Presson or in the bounds shall now work under said Cowell on said road and said road is Established in the 1st Class.

Issued 8th Dec. 1842.

On Motion it is ordered by the Court that R.C. Petty be appointed overseer of the road from Kirkman's ferry to where it intersects the stage road with the following hands (to wit) Ben Thompson, Charles Thompson, Wm. Farrer, W.K. Aden, B.M. Holland, James Rupell, Z. Collins, E.F. Wills and hands, John M. Petty all to work under sd. Petty on sd. road and said Road is established in the 2nd Class.

Issued 8th Dec. 1842.

The last will and Testament of Jeremiah Smith was this day produced in open Court and the due execution thereof proven by the oaths of Nathan Williams and Isaac B. Smith the subscribing witnesses thereto and ordered to be recorded, And Thereupon appeared in open Court William Smith the Executor Mentioned in the above named last will and testament and took the oath prescribed by law, as executor of the Estate of Jeremiah Smith Deceased and together with Nathaniel Nunnery and James Merrick his security entered into and acknowledged their bond in the sum of one thousand dollars conditioned as the law directs. It is ordered by the Court the estate of Jeremiah Smith Deceased to be Made out in due form of law when required.

Personally appeared in open Court Lewis Cottingham Admr. of the Estate of Wm. Pickler Deceased, and Made oath to an inventory & amount of sale of said estate filed at a former term of this Court.

Dec. Term 1842

On Motion it is ordered by the Court that Martha Wyatt be appointed Guardian of Harriet E. and Nancy J. Wyatt Minor heirs of Isaac Wyatt Deceased and thereupon the said Martha Wyatt together with John Pearce, her security appeared in open Court and entered into and acknowledged their bond in the sum of three hundred dollars, conditioned as the law directs.

Andrew J. Benton, Administrator of the estate of Willie Norman Dec'd. Made return of a supplementary Inventory of said estate and oath thereto having been Made. It is ordered by the Court that the same be recorded.

On Motion of Penelope Thompson and Charles Thompson Who Made oath according to law together with Thomas Jones and William Steele.  Their securities appeared in open court and entered into and acknowledged bond in the sum of three thousand dollars conditioned as the law directs.  It is ordered by the Court that they have letters of Administration upon the estate of William Thompson Dec'd.  And also upon the estate of Wiggins Collier deceased whose administrator the said William Thompson was to be Made out in due form of law when required.

Court then adjourned unto Court of Course.
