State of Tennessee, Benton County, April Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in April it being the 6th day of said Month in the year of our Lord one thousand eight hundred & forty six and the 70th Year of American Independence, there being present and presiding on the bench, the worshipfuls, Esqrs. (to wit) E. Perkins, J.K. Thomas, J.W. Davidson, D.P. Hudson, Eligah Alsop, Nathan Williams, D.M. Burkett, Wm. Barnes, David W. Benton, Wm. M. McAuley, Evans Jordan, J.D. Rushing, H. Greer, John Buchanan.

Personally appeared in open Court Sterling Brewer and produced a commission from his Excellency, A.V. Brown, Governor of the State of Tennessee commissioning him the said Brewer a justice of the peace in the 8th Civil District of Benton County.  Whereupon the said Brewer took oath to support the Constitution of the United States & of the State of Tennessee an oath against dueling and the oath of office.

The Clerk of this Court presented a settlement Made with Charles H. Thompson one of the Administrators of the estate of Wiggins Colier, deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Obediah Bullock, Administrator of the estate of Milly Nobles deceased which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court William Wesson, Administrator of the estate of Henry D. Walker, deceased and returned the sale bill of the property of said estate and oath having been Made to the same it is ordered by the Court to be recorded.

The Clerk of this Court presented a settlement Made with E.F. Wills, Treasurer of the board of Trustees for Benton County Academy which said settlement was examined and approved by the Court to be recorded.

April Term 1846

The Clerk of this Court presented a settlement Made with C.K. Wyly Treasurer of the board of Trustees for Benton County Academy which said settlement was examined and approved by the Court and ordered to be recorded.

Personally appeared in open Court one of the commissioners who was appointed at a former term of this Court to lay off and set apart a sufficiency of provisions to serve the widow and family of Henry C. Walker, deceased, Made report to this Court which was received and it is ordered by the Court to be recorded.

Personally appeared in open Court Robert Jones, Administrator of the estate of Isham Jones, deceased and Made return of the sale bill of the property of said estate and oath having been Made to the same it is ordered by the Court to be recorded.

On Motion it is ordered by the Court that Wilie Ratliff be appointed overseer of the road to work from Wm. Hubbs to John Walkers’, hands as follows, James Crabb, William Hubbs, Oswell C. Walker, Armsted Walker, Richard Pratt, Charles Duncan, James Walker, Whitfield Tippett, Daniel Massey, Ben Harrison, Henry Wood, Yancy Bohanan, John Crabb, Richard Cole and Wilson Barr and all other hands in the bounds shall work under said Ratliff on said road which is established in the 2nd Class.

The Court then proceeded to elect a coroner for the County of Benton for the Next ensuing two years and there being present and presiding on the bench a Majority of all the Justices in Benton County and all duly voting by ballot and the votes being counted it appears and therefore proclaimed that Seth Utley is duly and lawfully elected Coroner for said County for the next ensuing two years.

On Motion it is ordered by the Court that William Pafford be attached to the fifth Civil District of Benton County and that the Clerk of this Court strike his Name off of the list of Taxable property and polls, returned by the Revenue Commissioners of the 7th Civil District of said County.

April Term 1846.

On Motion it is ordered by the Court that J.K. Thomas, A. Lashlee, D.P. Hudson and Wm. P. Morris be appointed a committee to make such alteration in the plan of the Jail for Benton County as to the foundation of the house, the door and window jams of the dungeon as they may think necessary for the duration of the house and the strength of the dungeon and that they suggest the probable amount of the cost of such alteration to the Next quarterly term of this Court.

Personally appeared in open Court Amos Bruce and produced a certificate of his election of the office of Trustee of Benton County for the Next ensuing two years and together with him Robert Rushing, Nicholas Brewer, D. Brewer and J.W. Utley, his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Five thousand dollars conditioned as the law directs.   Whereupon said Bruce took the oath prescribed by law.

Personally appeared in open Court James E. Merick, Cullen Nowell, Isaac Anderson, Mitchel; E. Johnson, Samuel Madden, A.G. Holt, Wm. Greer, Ichabod Farmer, Elijah M. Bush and John Wyatt, Constables, elected in the County of Benton for the next ensuing two years who severally appear in open Court with their security and entered into and acknowledged the due execution of their bonds in the penal sum of Four thousand dollars each conditioned as the law directs.  Whereupon they severally appeared in open Court and took an oath to support the Constitution of the United States and of the State of Tennessee an oath against dueling and the oath of office.

Personally appeared in open Court David Brewer and produced a certificate of his election to the office of Sheriff of Benton County and together with him Jackson Rushing, David Morris, Amos Bruce, Nicholas Brewer, William Northington, Thomas Swindle and Timothy Reaves who appeared in open Court and entered into and acknowledged the due execution of the bonds in the penal sum of Fourteen thousand dollars conditioned as the law directs.  Whereupon the said David Brewer appeared in open Court and took an oath to support the Constitution of the United States and of the State of Tennessee, an oath against dueling and the oath of office and the bonds above mentioned are in the words and

Know all Men by these presents that we, David Brewer, Jackson Rushing, David Morris, Amos Bruce, Nicholas Brewer, William Northington, Thomas Swindle and Timothy Reaves, all of the County of Benton are held and firmly bound unto Aron V. Brown, Governor of said State for the time being and his successors in office in the penal sum of Twelve thousand five hundred dollars for which payment well and truly to be Made we bind ourselves, our heirs and legal representatives, jointly & severally firmly by these presents sealed with our seals and dated this the 9th day of April 1846.

The condition of the above obligation is such that whereas the above bound David Brewer has been duly and constitutionally elected Sheriff of the County of Benton as appears by the certificate of the proper officer as directed by law which certificate bears date the 9th of March 1846.  Now if the said David Brewer shall well and truly execute and due return Make on all process and precepts to him directed and pay and satisfy all fees and sums of money by him received by virtue of any process into the proper office as directed by law or by which the same ought by the tenor thereof to be paid or the person or persons to which the same shall be due his, her or their executors, administrators, Attorneys or Agents and all other things well and truly and faithfully execute the said office of Sheriff during his continuance of office then the above obligation to be void otherwise to remain in full force and effect.

of Five hundred dollars the payment of which well and truly to be Made we bind ourselves, our heirs and representatives jointly and severally firmly by these presents sealed with our seals and dated this the 6th day of April 1846.

The condition of the above obligation is such that whereas the above bound David Brewer was on the first Saturday of March in the year 1846 duly and lawfully elected sheriff and collector of the public taxes in and for the County of Benton by the qualified voters thereof for the term of two years next ensuing.

Now if the said David Brewer shall well and truly collect all State taxes and also all taxes on school lands within said County which by law he ought to Collect and shall truly account for and pay over all taxes by him collected or which ought to have been collected by him as such sheriff and collector as aforesaid on or before the first day of December 1846, to the Treasurer of the State then his obligation to be null and no effect otherwise to be and remain in full force from the date above.

April Term 1846

The condition of the above obligation is such that whereas the above bound David Brewer was on the first Saturday of March in the year 1846 duly and lawfully elected Sheriff and collector of the public and County taxes thereof for the term of two years next ensuing.

Now if the said David Brewer shall well and truly collect all County taxes and Revenue within said County which by law he ought to collect and shall well and truly account for and pay over to the Trustee of said County of Benton all County taxes and revenue by him collected as should have been collected on or before the first day of December 1846.  Then this obligation to be void and of no effect otherwise to remain in full force from the date above.

Making in all 82 white polls and all being present and presiding on the bench a Majority of all the Justices in Benton County and all voting in the affirmative, it is ordered by the Court that the Sheriff and Collector as aforesaid have a credit for said insolvencies and that the Clerk of this Court certify the part of the State tax to the Comptroller of the Treasury and the County part to the Trustee of Benton County accordingly.

The Court then proceeded to Make and appropriation to Nathan Williams a Justice for said County for his services in the absence of the Coroner of Benton County for summoning Jury and holding inquest over the body of Joseph Talbot, decd.  And there being present and presiding on the bench a Majority of all the Justices of Benton County and all voting in the affirmative, it is therefore ordered by the Court that the said Williams be allowed and paid the sum of Five dollars for said services by the Trustee of said County out of any money in the treasury for General County purposes not otherwise appropriated.

April Term 1846.

The Court proceeded to Make an appropriation to S.C Adens for holding the election in Benton County for the year 1844.  And there being present and presiding on the bench a Majority of all the Justices in said County & all voting in the affirmative it is ordered said Aden be allowed and paid the sum of Two dollars & fifty cents for said services by the Trustee of Benton County out of any money in the treasury for general County purposes not otherwise appropriated.

Issued May 26th 1846.

The Court then proceeded to Make an appropriation to the Revenue Commissioners for taking a list of Taxable property and polls in Benton County for the year 1846 who are as follows: Evans Jordan, Nathan Williams, S.H. Davidson, J.W. Davidson, D.P. Hudson, H. Greer, Geo. W. Farmer, Eligah Alsop and John Buchanan and there being present and presiding on the bench a Majority of all Justices in Benton County and a Majority of said Justices in Benton County and a Majority of said Justices voting in the affirmative.  It is therefore ordered by the Court that the sum of Three dollars each (Making in all Twenty seven dollars) be allowed said Revenue Commissioners for said services, and that the Trustee of Benton County pay the same out of any Money in the Treasury for general County purposes not otherwise appropriated.

April Term 1846.
Tuesday Morning.

Court met according to adjournment.  Present and presiding on the bench the worshipfuls, Esqrs. E. Perkins, Nathan Williams and J.R. Williams.

On Motion it is ordered by the Court that Daniel B. Herndon be appointed overseer of the road leading from Willis Rushing to Point Mason to work from Willis Rushing’s to the forks of the road near Eligah Bush’s, hands as follows:  James Taylor, Wm Herndon, H. Melton, E. Phifer, Peter Phifer, C. Pafford, F. Waters, William Waters, W. Jones, T. Bush and all other hands in the bounds shall work under said D.B. Herndon on said road which is established in the 2nd Class.

Issued 9th April.

SethUtley, wha was on yesterday elected Coroner of Benton County this morning appeared in open Court and together with him David Brewer, J.W. Utley, Cullen Nowell and Samuel Madden, his securities who appeared in open Court and acknowledged the due execution of their bonds in the penal sum of Two thousand five hundred dollars conditioned as the law directs.  Whereupon the said Seth Utley took an oath to support the Constitution of the United States and of the State of Tennessee, an oath against Dueling and the oath of office.

On Motion it is ordered by the Court that James Greer be appointed overseer of the Paris road to work from the old Rushing Creek Meeting house to this end of the Turn Pike and all the hands that formerly worked under Henry Nisler or in the bounds shall now work under said Greer on said road which is established in the 1st Class.

On Motion it is ordered by the Court that James Watson be appointed overseer of the road in room of Jerimiah Perry to work from P. Mullinix’s to the ford of Wolf Creek, hands as follows Jesse Dilion, John Gossett, Dozier Temple, Amos Bruce’s hands, Henry Gossett, James Camp and hands and all other hands in the bounds shall work under said Watson on said road which is established in the 2nd Class.

April Term 1846

On Motion it is ordered by the Court that Joel Ozier be appointed overseer of the stage road to work from the Town of Camden to Burnside Creek hands as follows; Charles M. Sarrett, James B. Robertson, M.L. Travis, Daniel Holland, A.R. Carnes, J.B. Carnes, Thomas S. Looter and all other hands in the bounds shall work under said Ozier on said road which is established in the 1st Class.

Issued 11th April.

On Motion it is ordered by the Court that Berry W. Whitly be appointed overseer of the road to work from the forks of the road east of Willis Rushing to the Four Mile post, hands as follows; John Bell, Alford Ballard, James Bell, Charles Bell, J.A. Browning, J.R. Browning, J.M. Browning, James H. Homes, James Alston, E.D. Whitly, James Morris, James Prince and Wm. Holland shall work under said Whitly on said road which is established in the 2nd Class.

Issued April 11th.

On Motion it is ordered by the Court that the Sheriff proceed forthwith to open and hold and election in the first Civil district of Benton County for the purpose of electing a Justice of the peace for said district to fill the vacancy occasioned by the removal of Thos. R. Jett, Esqr.

Issued April 11th.
